Driving While Suspended and Driving While Revoked in Missouri, Kansas, and Iowa

DWS and DWR charges are very serious regardless of which state you are charged in, whether it be Kansas, Missouri, or Iowa. A first offense generally does carry a two day minimum jail sentence as per the statutes of many states along with a significant suspension period of your driver's license upon a conviction. Kansas will suspend you for a period of 90 days if you are convicted of a first offense driving while suspended and Missouri will suspend you for a year for the same thing (MO considers it a 12 point violation). For a second offense, 5 days in jail is more common, along with an even longer suspension period through the DOR. KS considers the DWS or DWR a "habitual violator" violation and if you are convicted of 3 violations over a 5 year period (such things as DUI, DWS or DWR, no insurance, leaving the scene of an accident, or reckless driving), you will be suspended for a period of three years.

With the help of a sharp attorney, many times driving while suspended or driving while revoked can be plead down to a lesser charge, such as failure to have your operator's license in your possession, depending on the circumstances of your suspension and your prior criminal history.
